Think Secret:”With video iPod debut near, time is running out for Apple to strike big movie content deals“:3

The biggest hurdle to overcome remains the competing desires between the movie industry and Apple over which model an online movie store should adopt, said the source, who has been involved in talks with Apple directly and indirectly and spoke on the condition of anonymity. Mr. Jobs is insistent that content be sold as a download-to-own model, as music is with the iTunes Music Store, but the movie industry as a whole favors the subscription model and appears unwilling to budge.

“What this has come down to is that Steve has to decide if he wants to play ball or not,” the source said. “There is not an ‘either/or’ here. The movie industry will not change their mind in their insistence of a subscription business. They might consider a download-to-own model together with subscription, but not [on its own].”

Mr. Jobs has said countless times that people want to own their music, not rent it, but has said little about the right model for movies. With music, Apple has stuck to its guns and not offered a subscription service like Napster and others have, a strategy appears to have been the right one as Apple continues to dominate the online music landscape. But the film industry is a different beast, and with studios more adamant than ever to protect their creations from being illegally copied it appears push will come to shove and Mr. Jobs will have little room for compromise, the source said.

Since selling Pixar Animation Studio to the Walt Disney Company and joining its board in January, the source said Mr. Jobs is now in the difficult position of being both distributor and creator at a movie studio that is partnering with a subscription service, Vongo, from the Starz Entertainment Group. Vongo is an on-demand service presently for Windows users offering unlimited rental access to more than 1,000 movies, concerts, sports events, documentaries and other programs, as well as a live, streaming Starz TV channel, for a flat fee of US$9.99 a month.

“He’s now on the other side of the table,” the source said. “He has no choice but to wear both hats. He has to find a compromise here. Unfortunately, he has few others choices and a subs model is not what he’d call a ‘compromise’. He either sticks with his current strategy and will get few in the (film) industry to play ball with him, or he goes with the majority. I happen to know that he’s learning a lot from the industry and Disney since joining the company. That is helping move this issue forward.”

“If [Jobs] doesn’t make a deal with either of these two companies soon, then whatever movie content deals he announces with this video iPod will be small in comparison,” the source said. “There is a distinct possibility no deal will be made. There will be no way to hide the disappointment consumers will have if a deal isn’t announced with either of these two main distributors.”

… “But people expect Apple to be a pioneer. Not being first is not their style, nor what the public and investors look for.”

While Apple may prefer an a-la-carte model, sources report engineers have adapted a version of the company’s FairPlay digital rights management technology to support a subscription services. FariPlay currently encrypts music with a limitation on the number of times a song or video can be burned to CD and what devices can play back music and videos purchased through iTunes. It is believed several additional technical features will be added to FairPlay for a subscription service, including automatic deletion of content on a specific date and deletion of content when a unique user ID is no longer updated from Apple’s servers.
